Concrete Contractor Sues Over Continually Changing Design Plans

Baker Concrete Construction is seeking damages of nearly $20 million from Savannah River Nuclear Solutions LLC for costs related to design changes for the facility at the U.S. Energy Deptartment's Savannah River site, says the contractor's attorney.

Baker's lawsuit is claiming that the Fluor Corp team managing the project mislead the company about the status of design completion. Baker says when it bid and won a fixed-price contract of $91.5 million, the company was told "over 98 percent of all drawings released for solicitation by SRNS were represented to be accurate, significantly complete, sufficient and 'issued for construction.'" However, the contractor is claiming design changes have been on-going since the start of the project in 2009.
