Pending Legislation Could Have Major Impact on Construction Contractors

Florida, Colorado, Washington and Arizona all have legislation in the works to downsize construction-defects laws, which allow homeowners and homeowner associations to sue builder for construction defects even years after the home is completed and sold. Nevada has taken it one step further as Governor Brian Sandoval signed a revised Homeowners Protection Act which incorporates new rules that more tightly define defect as well as well as remove the requirement for the losing party to pay the other's legal fees. The revised act also reduces the length of time a homeowner has to make a construction-defects claim from 10 years down to six years.

Meanwhile, Indiana is one vote away from repealing its common construction wage law which allows communities to decide how much to pay contractors for public works projects. Advocates fro repealing the law say it will help non-union and local workers to win public works contractors. Defenders of the law say repealing the practice is a direct shot at organized labor.
