Ruling on DC CityCenter Prevailing Wages Could Impact Future Public Construction Projects

A disagreement over construction wages for work on the District's CityCenter may impact future public construction projects in Washington D.C. A U.S. Court of Appeals for the D.C. Circuit will determine if construction workers who built CityCenter are owed $20 million in additional wages because the District did not conform to the Davis-Bacon Act prevailing wage rule.

Both sides made their arguments on September 10 and are awaiting a ruling from the three-judge panel, which could come later this year or early next year. If the court rules projects on land leased from the District are subject to Davis-Bacon then tens of millions of dollars could be added to the cost of projects throughout the city.

Once the ruling is decided, either party could choose to appeal it or petition the U.S. Supreme Court to hear it.
