Judge Dismisses Antitrust Lawsuit Against Caterpillar

Judge ruled International Construction Products (ICP) could not prove the existence of an agreement between Cat and other manufacturers to boycott IronPlanet if the company worked with ICP

A Delaware judge last week dismissed an antitrust lawsuit from International Construction Products LLC (ICP) against Caterpillar and other heavy equipment manufacturers. ICP claimed that Cat, Komatsu and Volvo Construction Equipment threatened to boycott IronPlanet Inc. if IronPlanet helped ICP sell equipment. The judge ruled ICP provided "no facts that directly show the existence of an agreement" among the manufacturers.

In addition, the judge claimed ICP did not lack alternative means of distributing machinery and that Caterpillar does not have monopoly power over the market.
