GENERAL OFFICIAL RULES OF PROMOTIONS FOR IRONMARKETS
SPONSOR: IRONMARKETS, 201 N Main St., Fort Atkinson, WI 53538 (unless otherwise specified in the Contest/Sweepstake Specific Rules).
See also Promotion Rules and regulations (“Specific Rules”), above. Should there be any inconsistency between the two Rules, the Specific Rules shall prevail, govern and control.
ELIGIBILITY: Unless indicated otherwise in the Specific Rules, Promotions are open to legal U.S. residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years or older at the time of entry (the “Entrant”). Entrant must be an employee, owner or associated with the business/industry in which the Specific Rules outline. Employees and officers of Sponsor and each of its subsidiaries, affiliates, advertising/promotion agencies, and any others engaged in the development, production, execution or distribution of the Promotion, and the entities supplying the prizes (collectively referred to herein as “Promotion Entities”), as well as immediate family members (spouses, siblings, children and parents, regardless of where they live) or members of the same households (whether related or not) of such employees and officers of Sponsor and its affiliated entities, are not eligible to participate. The Promotions are void outside of the fifty (50) United States, District of Columbia, and wherever else restricted or prohibited by law. By entering, Entrants indicate their full and unconditional agreement to, and acceptance of, the Rules and the decisions of the Sponsor, which are final and binding in all respects.
GENERAL RULES OF PARTICIPATION: By participating, Entrants and prize winners [a] agree to be bound by the Rules and the Sponsor’s decisions, which are final and binding in all respects; and [b] release each and all of the Promotion Entities, from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Promotions, and/or the receipt or use/misuse of the prize awarded, including, without limitation, liability for personal injury, death or property damage. Sponsor reserves the right permanently to disqualify from a Promotion any Entrant or prize winner it believes has violated these Official Rules. Sponsor may prohibit an Entrant from participating in a Promotion or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Promotion by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other Entrants, Sponsor, or Promotion Entities. If for any reason a Promotion is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and selected prize winner(s) based on the entries received up to the cancellation, modification, termination, or suspension date. Notification of such action will be provided on the Sponsor’s Website (listed in the Specific Rules. To the fullest extent permitted by law, Entrants covenant not to sue any Promotion Entity or cause them to be sued regarding any matter released above; and further covenant not to disaffirm, limit or rescind any releases. A waiver by one or more of the Promotion Entities of any term in these Official Rules does not constitute a waiver of any other provision. CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF A PROMOTION (INCLUDING CHEATING, DECEPTION OR UNFAIR PLAYING PRACTICES) MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW AS WELL AS DISQUALIFYING THE ENTRANT FROM THE CURRENT PROMOTION AND FUTURE PROMOTIONS.
Sponsor and Promotion Entities are not responsible for any entry that is lost, late, misdirected or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions; or, not received due to hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise.
NO LIABILITY: By participating, Entrants and prize winner(s) agree to release, discharge, indemnify and hold harmless the Sponsor and the Promotion Entities, and each of their respective officers, directors, employees, representatives and agents from and against any claims made by a prize winner, Entrants, or any other third parties, related in any way to the operation of a Promotion as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, acceptance, possession, misuse or use of a prize; participation in any Promotion-related activity; or participation in a Promotion.
DISPUTES: Entrants agree that any and all disputes, claims, and causes of action arising out of, or connected with, a Promotion or the prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the state of Wisconsin. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, an Entrant’s rights and obligations, or the rights and obligations of Sponsor in connection with a Promotion, shall be governed by, and construed in accordance with, the laws of Wisconsin, without giving effect to any choice of law or conflict of law rules (whether of Missouri or any other than Wisconsin. Any and all claims, judgements, and awards shall be limited to out-of-pocket costs incurred, including costs incurred in entering the Promotion, but not including attorney’s fees and Entrant waives all rights to claim punitive, incidental, and consequential damages and any other damages and rights to have damages multiplied or increased.
HOW TO ENTER: See Specific Rules of a Promotion on how to enter that respective Promotion. Only the method of entry outlined in the Specific Rules will be accepted. The Website will be the official timekeeping device for each Promotion.
In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the Authorized Account Holder (defined below) of the e-mail address the Entrant supplied at the time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to the email address by the organization. An Entrant may be requested to provide Sponsor with proof that the Entrant is the Authorized Account Holder of the email address associated with the entry.
Any attempt by any Entrant to enter a Promotion using multiple/different accounts or any other methods may void the Entrant’s entry and may result in disqualification, at the sole discretion of Sponsor. Use of any automated system to participate in a Promotion is prohibited and may result in disqualification.
Entries not meeting the requirements as set forth in these Rules or the Specific Rules or that contain prohibited, inappropriate, or irrelevant content, as determined by Sponsor in its sole discretion, will not be eligible and will be disqualified. Any entry suspected by Sponsor of violating the proprietary rights of any third party (including but not limited to intellectual property rights and rights of privacy/publicity), or any local, state or federal law(s) will be disqualified, at Sponsor’s sole discretion.
Entries that violate the Rules, as determined by Sponsor, in its sole discretion, shall be disqualified from a Promotion. Sponsor reserves the right to disqualify an entry with offensive content or material that it feels is inappropriate in any way. Late entries or entries sent via any other method than those stated in the Specific Rules will not be accepted.
PRIZES: The available prize(s) vary with each Promotion; see Specific Rules for prize information. Prizes are non-transferable, non-assignable, and not redeemable for cash, except at the sole responsibility of the Sponsor. All taxes on prize are sole responsibility of prize winner. Sponsor, in its sole discretion, may substitute a prize of equal or greater value for any reason.
There is a limit of one (1) prize to be awarded per Entrant per Promotion. Prizes are provided in as-is condition without warranty of any kind, express or implied. No replacements will be provided regardless of the condition of the prize at delivery. Sponsor, Prize Provider, and their agents and representatives expressly exclude all implied warranties, including warranties of merchantability or fitness for a particular purpose. Sponsor shall have no liability or responsibility with respect to fulfillment, shipment, delivery or condition of any prize.
No more than the number of prizes set forth in the Specific Rules will be awarded. Except as otherwise set forth herein, all prizes will be awarded.
SELECTION OF WINNERS/ODDS OF WINNING: On or about the drawing date outlined in the Specific Rules, prize winner(s) will be randomly selected from among all eligible entries received during the Promotion Period. The random drawing will be conducted by a Sponsor representative whose decisions are based upon Sponsor’s sole discretion and interpretation of the Rules and are final and binding in all respects. Odds of being selected as a prize winner are dependent upon the total number of entries received during the Promotion Period.
NOTIFICATION/PRIZE CLAIM: Prize winner(s) will be notified by the Sponsor on or about three (3) business days following the drawing date (the “Notification”). The Notification will be notified via any of the contact information supplied at the time of entry. The Notification will request that the Prize Winner respond with the following information: first name, last name, street address, city, state, zip code, phone number, birth date and email address (the “Required Information”) within three (3) business days of receipt of the Notification. Upon receipt of the Required Information, the prize winner will be shipped the prize within a reasonable time frame based upon availability. If a prize exceeds $600 in value or if required by the Sponsor or Prize Provider, the prize winner will be responsible for completing an Affidavit of Eligibility/Liability/Publicity Release (“Paperwork”) form along with an IRS Form W-9 or any other required documents required by the Sponsor/Prize Provider.
In the event that: (a) a prize winner fails to respond to the Notification within the three (3) business days of receipt of the Notification; (b) a prize winner fails supply all the Required Information or Paperwork; (d) any Notification is returned as undeliverable; and/or (e) it is determined by the Sponsor, in its sole discretion, that a prize winner is not eligible in accordance with these Official Rules, such prize winner will be disqualified and an alternate prize winner will be selected from among the eligible entries received for the Promotion. Prize winner consents to use prize winner’s name, address (city & state), voice, biographical information, and/or likeness for purposes of advertising, promotion and publicity, for the Promotion only, without further compensation, unless prohibited by law.
PRIVACY: The collection of personal information provided in connection with these promotions will be used in accordance with the privacy policy located at https://www.forconstructionpros.com/page/privacy-policy.
WINNERS LIST REQUEST: For the name of the Prize Winner(s), please submit a self-addressed, stamped envelope within one month of the drawing date to the Sponsor address and included the title of the name of the promotion stated in the Specific Rules within the address name.
These promotions shall not be published without permission of the Sponsor.
