A 6-3 Texas Supreme Court ruling overturned a previous jury's verdict that a Genie construction lift was unreasonably dangerous after a man was killed when it was moved while fully extended. The ruling said that workers tried to move the lift while it was 40 feet in the air despite signs on the machine and user manual instructions warning of the obvious danger the lift would tip over. Because the danger is so obvious, the court ruled the Genie AWP-40S aerial lift is not unreasonably dangerous.
