FL Contractor Must Pay Misclassified Independent Contractors $180K in Back Wages

Department of Labor says Gomez Drywall Construction misclassified 108 workers and failed to pay overtime wages violating the Fair Labor Standards Act

Florida-based Gomez Drywall Construction Inc. is being required to pay 108 Louisiana-based workers nearly $180,000 in back pay after a U.S. Department of Labor investigation uncovered the contractor misclassified workers as independent contractors and failed to pay them overtime wages — a violation of the Fair Labor Standards Act.

The Department of Labor's investigation arose after a former worker filed a class-action lawsuit against the contractor in August 2018.
