EPA Sues Navistar for Violation of Clean Air Act

Lawsuit claims Navistar sold over 7,000 diesel engines built in 2009 that violated 2010 EPA emissions standards

The U.S. Environmental Protection Agency (EPA) is suing Navistar International Corp. over the sale of heavy-duty tracks in 2010 which the EPA says violated the Clean Air Act.

The lawsuit, filed in District Court for Northern Illinois in Chicago, claims Navistar sold nearly 7,750 diesel engines built in 2009 that violated the EPA emissions standards that took effect in January 2010.

Navistar maintains the engines should be allowed as "transitory" units; however, the EPA says Navistar did not secure the proper exemptions to use the engines.

The lawsuit reportedly seeks as much as $37,500 a day for each violation in civil penalties.
