Foreman Sentenced to Jail After 2015 Unshored Trench Accident Killed Laborer

Foreman acquitted of manslaughter but convicted of criminally negligent homicide and reckless endangerment in the laborer's death

Wilmer Cueva, foreman for Sky Materials, received a one- to three-year jail sentence for his rollin a 2015 cave-in of an unshared trench that killed an immigrant laborer. Cueva was acquitted of manslaughter but convicted of criminally negligent homicide and reckless endangerment in the laborer's death.

Sky Materials has not been tried yet. General contractor Harco Construction LLC was convicted and ordered to fund public service ads. Marco's site supervisor received probation and community service for criminally negligent homicide after a plea deal.

Cueva's lawyer argued his client was a low-level laborer with minimal safety training and complained his client was lowest man on the totem pole but was getting the harshest punishment.
