New Hampshire-based general contractor S&R Construction Enterprises has agreed to pay more than $420,000 after submitting false and inflated payment requests for construction of the Assembly Square Station on the Massachusetts Bay Transportation Authority’s (MBTA) Orange Line in Somerville, according to Attorney General Maura Healey.
S&R Construction, its president Stephen Early, subcontractor A&S Electrical and its manager Gregory Lane agreed to resolve the allegations of violating the Massachusetts False Claims Act.
According to the complaint, S&R Construction and A&S Electrical knowingly submitted false and inflated payment requests reflecting the companies had purchased construction materials in greater quantities or at higher prices than actually purchased.
In addition, S&R Construction was cited for failure to pay prevailing wage and failure to submit true and accurate time records on the Assembly Square Station construction project and construction of the Wachusett Commuter Rail Station on the Fitchburg Line. S&R Construction will pay over $40,000 in restitution to employees and over $25,000 in penalties.
S&R Construction and A&S Electrical have been barred from bidding on and accepting new public contracts in Massachusetts for five years and one year, respectively.
